Frequently Asked Questions: St. Catharines Family Law

Yes. In Ontario, existing family law orders (for decision-making responsibility, child support, spousal support, and more) can be changed if there has been a material change in circumstances since the order was made.

To modify an order, you can negotiate an amendment with your former partner, participate in mediation, or bring a motion to change in court. Your St. Catharines family lawyer will help you determine whether you qualify for a motion to change and represent you throughout the variation process.

Yes. As long as you have lived in Ontario for at least one year before starting your divorce application, you can file for divorce in the Ontario court system. This is true even if your spouse lives somewhere else in Canada. This is usually referred to as the “residency requirement” in the Divorce Act.

If there are additional issues such as child support, parenting arrangements, or property division, the Ontario court will also consider whether it has jurisdiction over those matters.

Absolutely. While we have a convenient office presence for clients in St. Catharines and across the Niagara region in smaller towns, Gelman & Associates regularly assists clients across Ontario. Many aspects of our family law practice can be handled by phone, video conferencing, or secure document exchange, so you don’t necessarily need to live nearby or meet with us in person to get started with your family law case.

We also have a total of 11 different locations throughout the province.
